Divorce FAQ

What does "no fault divorce" mean?

Nevada is a "no fault divorce" state. This means spouses can divorce one another without having to prove that the other spouse was responsible for the breakdown of the marriage.

However, there are currently only 3 grounds (reasons) for divorce in Nevada:

  • Incompatibility (irreconcilable differences)
  • Insanity that existed for at least 2 years before filing for divorce
  • The spouses have lived separate and apart for 1 year

Based on one of the above grounds, a spouse can file for divorce as long as either spouse has been a resident of Nevada for at least 6 weeks prior to the filing.

What is an uncontested divorce?

Uncontested divorce is a process where both spouses agree on all issues and terms of the divorce including: how they will divide their marital assets; arrangements for child custody; settling child or spousal support payments.

In this case, the spouses just need to file a Joint Petition for Divorce in court.

What is a contested divorce?

If both spouses disagree on some or all of the terms of the divorce, they should pursue the contested divorce process, which begins with a Complaint for Divorce filed by one spouse in court.

From there, the couple will have to go through a settlement phase where their Reno divorce attorneys negotiate (outside of the court) to reach a final agreement on matters like child custody and property division.

If negotiations fail, they will have to go to trial to settle the divorce with a judge. Contested divorces can take 3-6 months, though complicated cases may take longer.

What factors impact a judge's decision about child custody?

One of the most important steps in divorce is settling the marital disputes like child custody and property division, among others. While spouses may negotiate their own agreement, such as in mediation, failure to reach a complete agreement will require the couple to resolve the disputes in court before a judge.

Some factors include:

  • Child's wishes, if the child is of sufficient age and capacity to form an intelligent preference
  • Level of conflict between the parents
  • Parents' mental and physical health
  • Nature of the child's relationship with each parent
  • Child's ability to maintain a relationship with any siblings
  • Parent more likely to allow the child to have frequent association and a continuing relationship with the other parent
  • Parents' ability to cooperate to meet the child's needs
  • Child's physical, developmental, and emotional needs
  • Any history of parental abuse or neglect of the child or a child's sibling

Also included is whether either parent has committed an act of abduction or domestic violence against the child, the other parent, or any other person residing with the child.

What factors impact a judge's decision about fair property division?

Whether or not there are children affects the judge's decision about property division as well, but other factors are also taken into account.

Some of those factors include:

  • Each spouse's income and earning potential
  • Custody arrangement (related to which spouse gets the marital home)
  • Each spouse's financial resources
  • Whether one spouse supported the other's education and training during marriage
  • Each spouse's age, physical, and mental health
  • Any other relevant factor
